Terms of Use – Claim Form

These Terms of Use (“Terms”) apply when you use this online claim form (the “Claim Form”) to notify or submit an insurance claim. The Claim Form is operated by ClaimSorted on behalf of your insurer or its managing agent. Please read these Terms carefully before using the Claim Form. By using the Claim Form, you agree to these Terms.

1. Who we are

This Claim Form is operated by ClaimSorted as a third-party claims administrator acting on behalf of your insurer. The ClaimSorted entity responsible is ClaimSorted EU Ltd (24A Baggot Street Upper, Dublin, Ireland) for customers in the European Union, or ClaimSorted Ltd (company number 15848796, 124 City Road, London, EC1V 2NX, United Kingdom) for customers in the United Kingdom. In these Terms, “ClaimSorted”, “we”, “us” and “our” refer to the relevant entity, and “you” and “your” refer to the person using the Claim Form.

2. About this Claim Form

The Claim Form lets you tell us about an incident, submit a claim under your insurance policy, and upload supporting documents. It does not change the terms of your insurance policy. The cover available to you, and any decision on your claim, is governed by your policy wording and applicable law — not by these Terms.

3. Using the Claim Form

When you use the Claim Form, you agree to:

  • provide information that is accurate, complete and not misleading;
  • only submit a claim that relates to you or that you are authorised to submit;
  • only upload documents and files that you have the right to share; and
  • not misuse the Claim Form, including by attempting to gain unauthorised access, uploading harmful or malicious software, or interfering with its normal operation.

You must be at least 18 years old or have the legal capacity to enter into a binding contract. You agree to use the Claim Form only for lawful purposes and in accordance with these Terms. Claim Forms submitted on behalf of a minor, or a person without legal capacity to enter into a binding contract, must be completed and submitted by the parent or legal guardian of that minor or person.

Providing false or misleading information, or submitting a fraudulent claim, may affect your claim and may be reported to the relevant authorities.

4. The information you provide

You are responsible for the information and documents you submit. Where you provide personal data about other people (for example, family members or witnesses), you confirm that you are entitled to share it with us for the purpose of handling the claim.

5. How we use your personal data

We process the personal data you provide in order to handle your claim on behalf of your insurer. Details of how your personal data is collected, used, stored and shared, and the rights available to you, are set out in our Privacy Notice. Please read it before submitting your claim.

6. Availability of the Claim Form

We aim to keep the Claim Form available and working properly, but we cannot guarantee that it will always be available or uninterrupted. We may suspend, withdraw or change all or part of the Claim Form for operational, legal or security reasons. If the Claim Form is unavailable, this does not affect your ability to notify your claim by other means set out in your policy documents.

7. Our responsibility to you

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Nothing in these Terms affects your statutory rights as a consumer. Subject to this, we are not responsible for losses that are not reasonably foreseeable or that are not caused by our breach of these Terms.

8. Intellectual property

The Claim Form, and the content and software that make it work (excluding the information you upload), belong to ClaimSorted or its licensors. You may use the Claim Form only to submit and manage your claim.

9. Your responsibility for misuse

To the extent permitted by law, you are responsible for any loss we reasonably suffer that is caused by your fraud, your deliberate misuse of the Claim Form, or your submitting information you know to be false or misleading, or a claim submitted without the authority of the person it concerns. This does not apply to anything caused by our own breach or negligence, and nothing in this section affects your statutory rights as a consumer.

If you are unhappy with the Claim Form or how your claim has been handled, you can contact us at complaints@claimsorted.com. Information about how to make a complaint is available in our Complaint Procedure and in your policy documents.

11. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in how the Claim Form works or for legal or regulatory reasons. The version that applies is the one published here when you use the Claim Form.

12. Governing law

If you are resident in the European Union, these Terms are governed by the laws of Ireland and disputes may be dealt with by the Irish courts. If you are resident in the United Kingdom, these Terms are governed by the laws of England and Wales and disputes may be dealt with by the courts of England and Wales. In each case, you keep the benefit of any mandatory consumer protections available to you under the law of the country where you live.
